We Don't Need a New Constitution

George Washington, James Madison and Ben Franklin did a magnificent job of producing our United States Constitution. Washington and Madison both called it a "miracle." It has protected our liberty for 220 years. Now some politicians (from both Right and Left) have the conceit and arrogance to think they can do a better job than the Founding Fathers.

So they are promoting the calling of a new Constitutional Convention (which some people call a Con Con). These politicians naively think they will be able to control the Convention and improve on the wording of our existing Constitution. Some politicians are promoting just one amendment, others are promoting ten new amendments.

There is nothing wrong with our Constitution except that some politicians and judges don't obey it. The solution is to elect officials who obey our Constitution -- not rewrite or change the Constitution we have.

Article V of our Constitution allows a Constitutional Convention to be called if 34 states pass resolutions requesting it. The problem is, nothing in the Constitution or any law specifies the rules, who will be the Delegates, how they will be elected and apportioned among the states, whether amendments must be passed by a 2/3rds majority, or whether the agenda can be limited to considering just one amendment, or can approve 10 amendments or even a massive rewrite.

The highest authority who has spoken out on this subject is retired Chief Justice Warren Burger, who wrote, "There is no effective way to limit or muzzle the actions of a Constitutional Convention. ... After a Convention is convened, it will be too late to stop the Convention if we don't like its agenda."

James Madison, often called the Father of the Constitution, wrote a prophetic warning against calling a convention to amend our Constitution. A convention, he wrote, "would no doubt contain individuals of insidious views, who under the mask of seeking alterations popular in some parts but inadmissible in other parts of the Union, might have a dangerous opportunity of sapping the very foundations of the fabric."

These "insidious views" could include efforts to eliminate the Second Amendment, to impose global governance through treaties, to create new constitutional rights such as same-sex marriage, abortion, and health care, and to eliminate the Electoral College.

A Constitutional Convention would give Barack Obama a fantastic opportunity to carry out his threat "to fundamentally transform the United States of America." He could elect Convention Delegates by activating his "Organizing for America," ACORN and government unions, all the while using George Soros's money. The Delegates would be trained and instructed by Obama via the internet just like the people who assembled in his 3,500 House Meetings to get Congress to pass his trillion-dollar Stimulus. The Mainstream Media, of course, would be a major player in the process, supporting Obama's goals and selecting those who would be featured on TV.

Americans must defeat any proposal to call a new constitutional convention.
